None of us know just what is around the corner, and in many cases, that's just as well. However, it is a sad fact of everyday life that people become involved in accidents, be it a fall, road traffic collision, accident at work or criminal assault. We all run these risks in our daily lives.

What are your rights?
If an event is a true accident, then in law there is no automatic right to compensation. If however, our injuries are caused by the negligence of another person, whether it be an employer, workmate or car driver, then you may be able to claim damages from that person or his insurers. The law on damages is complex and strict time limits can apply so it is essential to seek legal advice at once.

Was it a road accidents?
It is always best to report an accident to the police. They will prepare an accident report including the names and addresses of the parties involved, their insurance details and a list of witnesses. Some losses can be recovered under your own policy. Losses for personal injury and other out of pocket expenses will be a claim against the other party and their insurers. If you have serious injuries, your claim may take some time to settle. You may suffer wage loss. You may no longer be able to enjoy certain hobbies to the extent you did prior to the accident. Medical reports may be necessary to substantiate your claim. Consult your solicitor as soon as possible and they will be able to advise you on the conduct of your claim.

Did it happen at work?
Workplaces are notoriously fraught with danger. This can take many forms - unsafe working practices, noise pollution, faulty electrics etc. If you become ill or injured in your place of employment you are entitled to compensation and very often this is the only way of getting things changed for the better.

Was it a criminal assault?
If you are injured in a criminal attack, you may be entitled to criminal injuries compensation. The scheme is strictly controlled and your solicitor can assist you in your claim.

Did it involve negligence by a third party?
Where someone has failed in their duty to look after you, they should be accountable to you for their failure and your losses. Understandably, if the complaint is about a professional person or a trusted individual such as a doctor, dentist or advisor, then people are often uneasy about claiming compensation. Your solicitor can advise you if you have a legitimate claim.

How much does it cost?
Your solicitor will discuss this with you at the outset. If your claim is successful, often your legal expenses, or part of them, will be paid by the defender or his insurers. Your solicitor will advise you on the level of compensation you can expect and your chances of success. Legal Aid may be available.
